The Orissa Supreme Court has allowed a man to take custody of his 15-month-old son, finding that continuing custody of the toddler with the mother, who is now separated, will improve the child’s mental and physical development could and possibly also negatively affect his psychology. The court order came after watching a video showing the mother repeatedly mercilessly torturing and beating the child.

A department bank of Judges SK Mishra and Savitri Ratho on Friday ordered his wife to hand the boy over to his father within seven days while allowing a habeas corpus brief filed by a Chakradhar Nayak from Puri County. “If she fails to do so, the police will take appropriate measures to take the child out of the mother’s care and hand him over to the father,” the Supreme Court ordered.

“We found out from the video that the mother had mercilessly beaten the child several times. When we found the cruelty, torture and attack on the little boy, we instructed the police to ensure that the mother and the child were present,” so the Supreme Court said. Chakradhar and Rosalin from Paika Sahi under Gop Police Station have been married for over five years and have troubled married lives. On an earlier occasion, the man was arrested shortly after dowry charges and domestic violence allegations were made. However, the case was closed and they were reunited following a compromise initiated by the court.

The marital discord reappeared after the child was born, and the woman has lived with her parents with the baby ever since. Later, when Chakradhar learned that Rosalin was torturing the baby and beating the child to settle the bill with her estranged husband, he turned a habeas corpus petition to the Supreme Court to take possession of his son. Chakradhar has a retail store in Bhubaneswar and now lives with his sister and brother-in-law in the capital.
