Several recommendations, advocated by Jane Does Well, were taken up by the Task Force 2021.

These changes include:

1. Inclusion of language to handle simultaneous spousal and child support arrangements

The guidelines for 2021 quote Calvin C. v. Amelia A., 99 Mass. App. Ct 714 (2021), a case that clearly says:
Maintenance is first calculated when “the wife needs support and the husband is solvent”, which would result in a “fair compensation of the victims” between the parties. “The calculation of the maintenance requires the use of the adjusted income after the maintenance of the parties in the calculation of the child maintenance in order to avoid a conflict with GL. c. 208, section 53c2 “.

The guidelines make it clear that maintenance may be charged first; then the child support is calculated with the income adjusted for the spouse support.

2. Increasing the adjustment factors for several children

Before 2021, the adjustment factors were set 50% below the benchmark level. The 2021 Task Force corrected this discrepancy and increased the factors to make them consistent with other state and national benchmarks.

3. Increase of the current maximum total income cap from USD 250,000 to USD 400,000

The guidelines for 2021 clearly state that child support based on a total income of $ 400,000 is the presumed minimum order amount. Income over $ 400,000 can also be used to calculate child support, but at a lower percentage.

4. Abolition of the arbitrary 15% cap on childcare and health care costs

These costs are now borne by the parents on a pro-rata basis, which corresponds to the child benefit guidelines of all other states.
