Courtroom Declines to Award Girl Sh28,000 for Baby Assist, Challenges Her to Discover Supply of earnings for Shared Duty –

A court in Nyeri has refused to grant a woman and her child Sh 28,000 a month child support. The woman, identified only as JWM, wanted the court to force her ex-husband to pay the monthly fee.

Judge Florence Nyaguthii Muchemi said the lady was not employed and should therefore not place full maintenance responsibilities on the ex-husband.

The judge said the woman must show seriousness by trying to meet her obligations as parents. She said raising a child is a shared responsibility and the woman would ensure that she does not remain unemployed if she becomes self-employed for a small income.

“Small beginnings become big things. The complainant must endeavor to contribute to the child’s maintenance as required by law. She cannot fully rely on the respondent, whose income, taking into account his other responsibilities, has also been shown to be limited, “she explained.

JMW appealed a ruling in August 2018 that granted her full custody of the child. It should offer protection and take care of the ancillary costs.

The man who is married and in charge of another family makes 100,000 Shillings. He received visiting rights based on an agreement between the two parties. He should also enroll the child under his employer’s health insurance, pay school fees and bear the associated costs once the minor started school.

Both parents should donate Shill 6,000 a month for food and clothing for the child.

However, the woman was affected by the verdict and appealed. But Lady Justice Muchemi said the trial judge had examined all of the material presented before her and would not award the amounts requested by the woman.
