VOLUSIA COUNTY, Fla. (WFLA) – The court will decide whether the dog thrown over a motel balcony in Daytona Beach on Monday will be given to Animal Services or returned to its owner.

The German shepherd, nicknamed “Wunder”, who was rescued from her autumn Monday, is “fine,” said the Volusia Sheriff’s office. She is with a foster family who is recovering from her injuries.

“Should the court grant custody of Animal Services, the foster family has already expressed an interest in Miracle being part of their eternal family!” said the sheriff’s office.

The assistant body camera captured a shocking video Tuesday of 35-year-old Allison Murphy coming out of her motel door and throwing Miracle over the railing. According to the MPs, the dog landed on her feet. An X-ray showed the dog had a sewing needle in its thigh but was otherwise fine.

Murphy was brought to the ground after the incident and then arrested for cruelty to animals and resisting an officer.

A hearing is scheduled for the end of the month and the court will decide on Miracle’s custody.
