SPRING, Texas (KTRK) – A dog at the center of an investigation after biting a 3-year-old girl at a restaurant in Old Town Spring is currently in custody and at the Montgomery County Animal Shelter.

In addition, the Harris County Sheriff’s office informed ABC13 that they did not speak to the dog’s owner, but that evidence of possible charges is being presented to the prosecutor.

According to the sheriff’s office, the investigators know who the woman is, but have not been able to contact her directly.

The Waldroup family said they took their 3-year-old daughter Ronin to Loose Caboose in Old Town Spring. When the little girl walked into the restaurant a few steps in front of her family to order food, the Waldroup family said a dog in a service vest had bitten its face.

In a new surveillance video that ABC13 received Tuesday, the woman and dog are seen walking down the sidewalk with the girl’s father, James Waldroup, not far behind her. There is no audio in the video, but body language indicates an exchange between the two.

“There was an accident,” James recalled and said to the handler. “”[I said,] ‘You can’t go. My daughter is bleeding in a toilet and you are running down the street. ‘”
The woman then got into a car with a man and left.

The incident is under further investigation and no criminal charges have been filed against the owner.
